Terms and Conditions for Registered Artistes
Your contract with us
Please read the terms and conditions below carefully as it forms the binding contract (referred to as this “contract”) between you (referred to as “you” or “your”) and Extra People Limited of Sherwood House, Queens Road, Farnborough, Hampshire, GU14 6JP (Company No.05901254) (referred to as “Extra People” or “we”, “us” or “our”).
By submitting your application to be registered as an artiste with Extra People you agree to be bound by this contract.
You can apply to be included in our database of artistes (referred to as our “database”) by submitting the online application form.
Registering online with Extra People Ltd does not guarantee you will be entered on to our main casting directory. You may however be offered work on productions as a result of this registration. While we try our utmost to find work for everyone on our casting directory, we make no guarantee that you will be offered bookings at any time.
Information provided on the Extra People registration form may be entered onto the Extra People computer database and your pictures and profile may be used on the Extra People Website and brochures.
By creating a profile with us you are confirming you are legally entitled to live and work in the UK. Once you have created a profile, you must upload via our website proof of your right to work in the UK, whether this be with a passport or other eligible VISA or right to work documents. If you are only legally able to work a certain number of hours per week, then you must notify us in writing before accepting any bookings from us - please note that this may affect the types of work we can offer you and it will be your responsibility to not breach any work restrictions you may have.
By making an application:
You agree to be bound by this contract and to comply with instructions given to you either in the guide or otherwise by any member of staff of Extra People.
You confirm that you do not have any unspent criminal convictions (other than driving convictions), including sexual offences under the Sexual Offences Act 2003.
You are not on the sex offenders register and you have never been subject to any disciplinary action or sanction relating to vulnerable groups.
You agree to cooperate with any request from any production company to obtain a criminal record check.
You agree that either you are not knowingly allergic to any make-up or prosthetics, or you have informed us in writing.
You confirm that there are no material facts which you consider ought to be disclosed and could be pertinent to your engagement, or likely to cause illness, injury or damage to yourself or others, or you have informed us in writing of such facts.
You confirm that you are legally entitled to live and work in the UK.
You agree that we may publish your details (including your photographs) in the database, including your details on our website and any other materials, and forward your details to any production companies or any other client of Extra People (referred to as “production companies”) and to contact you with offers of bookings and details of other productions we are casting for, and about other services related to your bookings.
Protecting your Information
Under the Data Protection Act (1998) and GDPR (2018), we are the data controller of all your details we hold. We will use your details only for purposes related to this contract, or as agreed by you or permitted by law, including contacting you with offers of bookings and details of other productions we are casting for, and about other services related to your bookings. We will use appropriate measures to keep your details safe and secure. We will not sell, licence or trade your personal information to others. We will keep an archive of your details for so long as you remain on our database plus up to two years afterwards. You have the right to ask for this to be removed, but we will need to keep some personal details relating to any work you have done for legal reasons.
Under any request where you ask for your details to be removed, this will be done within 30 days of a written request. Please note we will need to keep details relating to any work you have done as we are legally required to do so.
Money Matters
We deduct a 20% (plus VAT) commission from all fees you receive for bookings which we arrange for you (referred to as “our commission”).
Commission is due to Extra People on any professional work obtained directly or indirectly through any introduction via Extra People. Extra People endeavours to pay the artist within ten working days of receipt of correct payment from the client.
Payments to artists will only be made once the corresponding payments from the client are received and cleared through the Extra People bank.
Extra People does not accept liability for bankrupt or defaulting clients who owe fees to artists, although every attempt possible will be made by Extra People to recover your money.
Payments made to Extra People may come from different companies and may not necessarily be paid in the order in which your jobs were completed.
Should you not fulfil, or be late for any booking, you shall be responsible for any waiting time or fees incurred.
Should you fail to turn up for a booking without giving prior notice and without good reason, your name may be removed from the Extra People register.
You should never be paid directly from a production company or AD when booked on a job through us acting as your agent. If this ever occurs, you agree to notify us as soon as possible and understand we would be entitled to invoice you for our commission including VAT if applicable.
After any engagement through us, you will receive a Pay Review which breaks down your earnings for the day. You will have a 24hr window in which to query any potential discrepancies in your earnings, after such a time you must inform us via e-mail to the e-mail address on your call details.
While we will always put your queries across to the production company for them to review, and then provide you with a written response either approving or rejecting any queries for additional pay. Sometimes the production will dispute a claim that you have made. While we will make every effort to make sure our artistes are paid fairly and according to the pay agreement upon which you have been booked, we are not on set - and therefore are unable to enforce pay disputes whereby you and the production have differing points of view.
Your Responsibilities
If you accept a booking we will expect you to attend. If for a specific reason you cannot attend, you must inform Extra People immediately so that we, in turn, can inform the client and, if necessary, replace you. We require a minimum of 24 hours notice. When accepting a booking from us you must contact us the day before to get your call time (preferably between 4pm and 6.30pm) although you may receive calls outside of these times.
Please acknowledge immediately any messages left for you by Extra People relating to work from us, whether you are available or not. Please keep a record of all bookings with dates, times, companies, hours worked etc.
Please arrive early for work. If you are going to be late please contact Extra People immediately to advise us what time you expect to arrive so that we may inform the production company.
On the day of work, please make sure that you sign out (if required to do so) and should you have queries about your grade or hours worked please raise these with the 2nd or 3rd Assistant Directors before you sign the release form.
Under any circumstance where you have accepted a booking - but have not re-confirmed the booking through a reminder message, or have not confirmed receipt of call details by 6pm.
We are within our right to replace you, and if you arrive at the production subsequently the production may not allow you on set and you will not be entitled to any payment for attending or for the cancellation of said booking.
If after 6pm you have not confirmed call details and you have been informed you are being replaced, then you need to contact the emergency contact as per the check in to inform us you are available and would be attending.
You are responsible for keeping the details on your profile correct and up to date. This includes your measurements and photographs - which are of particular importance as you could be sent home unpaid by any production who have been provided with incorrect information that you have inputted on your profile.
Your engagement on any booking is subject to a separate contract with the production company. However, any failure to sign the contract presented to you by production shall revert to this agreement, which in turn shall grant all rights asked of you. Extra People in turn, assure that all jobs we place you upon are of a quality that there should be no reasonable or unfair legitimate reason to not agree to the terms provided to you.
Some production companies make changes to this agreement, and the applicable version will be sent to you in the email from Extra People booking you for each engagement. Some production companies may require you to sign a written contract with them, this may be a digital signature, others may not require any additional formalities. If for any reason you are not able to sign this you give Extra People the right to sign this on your behalf as your agent.
By making a profile with Extra People, you are confirming to us that you are not on the sex offenders register and you have never convicted of any crimes relating to vulnerable groups, or any crime for which you have served a custodial sentence. If this changes, then you agree to inform us as soon as possible and recognise that this may affect the work we are potentially able to offer you, if at all.
We recognise people from all backgrounds should have the ability to work. If you are disabled or have any other health concerns that may affect your ability to take part in any particular capacity of a role or production, please inform us so we are able to offer roles which are suitable. There are sections on your profile where you can outline any additional needs you have.
Any inappropriate behaviour as reasonably determined by us, towards any member of production staff (including fellow supporting artistes) or any employee of Extra People will not be tolerated. We reserve the right to remove you from the casting database, and in extreme circumstances the production company may not wish to pay you for the booking.
Payments and Rates Quoted to Artists
We deduct a 20% (plus VAT) commission from all fees you receive for bookings which we arrange for you (referred to as “our commission”).
From time to time we may contact you to offer you bookings. We are not obliged to offer you any bookings at any time.
All rates quoted to artists are quoted before any deductions are taken, These deductions can include but are not limited to; commission, agency fees and national insurance (if applicable).
Extra People pay through the BACS system direct into your bank account. In association with our software partner, WEGOTPOP LTD, You will be sent a remittance advice detailing what has been paid into your account.
Please check both your bank statements and our remittance advice carefully. We will always try to answer any questions about fees due to you.
Should you fail to receive payment after a reasonable period, please inform us immediately. We may ask you to refer to your diary so please have any dates and details ready before you contact us.
Please allow between 30 - 90 days for payment to reach your account. We must wait until the production company has made payment to us before we can transfer money to you. You must ensure your bank details are correct and up to date at all times, we cannot be held responsible for retrieving payments into bank accounts where the details are inaccurate.
If you receive any fees directly from the production company Extra People is entitled to invoice you for our commission. This will be a VAT invoice, where appropriate.
On some TV and film productions, you will be given a salary voucher (a chit) at the beginning of each filming day. It is your responsibility to keep hold of this, make sure it is signed at the end of each day by an appropriate member of the production company, and return it to the production company. You will receive a copy of your salary voucher which you must keep as proof that you worked that day. The production company may refuse to pay your fees if it does not receive a signed salary voucher at the end of the day and we are entitled to invoice you directly for our commission on the fees you would have been paid.
Most Productions will use our online payments platform ‘chitless’ provided to us by our software provider, WEGOTPOP LTD. You agree to your payments being processed to you via this platform and in most cases, you will be sent after your work, a 24h review for your to approve or raise any queries regarding your pay.
For tax purposes, you are considered self-employed. You are therefore responsible for paying your own income tax and completing your own annual tax return. For more details please contact your local tax office.
You are considered self-employed for National Insurance purposes. You will not have a Class 1 National Insurance deduction from your payment and you will receive all payments without National Insurance deductions. You will be responsible for paying any Class 2 National Insurance and where applicable Class 4 National Insurance which will be payable along with your self-assessment income tax. Under no circumstances are you considered an employee of Extra People.
Once we accept your application, you appoint Extra People to act as your non exclusive agent in finding you bookings as an extra, background artiste, walk-on artist, or other similar work (referred to as “bookings”) with production companies in accordance with this contract. You are not in any circumstances engaged as an employee or contractor of Extra People.
By registering with Extra People Ltd you understand and agree that you are not an employee of Extra People Ltd. Rather, You agree that you are retaining us to perform services for you, unless agreed otherwise. You agree that you are liable for your own Tax and National Insurance as a self-employed person, unless agreed otherwise.
All commission charges are subject to VAT as per government rulings where appropriate.
Press and Publicity
Any publicity resulting from a booking must be discussed with Extra People first. The artist is reminded that script and programme confidentiality is vital and that you must not disclose information about any character or programme or commercial without prior permission from Extra People, the Production company and/or Advertising Agency. We expect our artists to maintain a professional standard at all times.
The work you do on any booking is strictly confidential, and you must not disclose any details to any person. For example:
You must not make any film or sound recording or take any photographs while on any set.
You must not contact any journalist, newspaper, magazine or other publication about any production you have worked on.
You must not post any comments or photographs on any website, blog or social network about any production you have worked on (this includes Facebook, Twitter, Instagram, Snapchat, WhatsApp or any other social media platform ).
Any breach of the above will result in immediate termination of your employment with the production company and also the agency and this contract will be terminated.
Miscellaneous
By accepting a booking from Extra People and attending an engagement in any capacity, it is reasonably assumed that you agree to be bound by that production company agreement. If for any reason you are not able to sign any additional agreements - either on the day or subsequently, you authorise Extra People as your agent to sign this on your behalf, so that you may be paid - as failure to sign such agreements means payment would be withheld.
The production company is responsible for taking out personal injury insurance to cover any cast member, crew or supporting artiste on their set.
Extra People is not liable if you are injured on any engagement - or responsible for any loss, damage or theft of any of your possessions.
If you are on set and notice anything which would be a health and safety risk of you or others, please immediately report this to the appropriate member of the production team. We also will act on any such reports made to us, and will raise it with said production company.
You are not entitled to sub-contract, assign, transfer, or otherwise dispose of your rights or obligations under this contract.
If you or we fail to require the performance of any terms of this contract or you or we waive any breach of this contract, this will not prevent you or we later enforcing such term, nor be deemed a waiver of any subsequent breach of this contract.
Should any provision of this contract be declared invalid for any reason, such a decision will not affect the validity of any remaining provisions which will remain in force and effect. In those circumstances, we are entitled to replace the invalid provision with a provision of similar or equivalent economic effect, by written notice to you.
Nothing in this contract is intended to or shall operate to create a contract of employment, partnership or joint venture of any kind between you and us, or to authorise you to act as our agent. You shall not have authority to act in the name or on behalf of or otherwise bind Extra People in any way.
Whenever under this contract any sum of money is payable by or recoverable from you and due to us, then we may deduct or set-off the amount of such sum from any fees we receive on your behalf, and we will notify you that we have done this.
Nothing in this contract confers any rights or benefits on any person or legal entity other than you or us.
This contract constitutes the entire agreement and supersedes all previous verbal or written agreements between you and us. Except for the information you provide to us in your application, or otherwise as expressly stated in this contract, neither you nor us have relied upon any statement or representation made by the other in entering into this contract.
This contract, all matters regarding the interpretation or enforcement of it, and any other matters or disputes arising in connection with it shall be governed by English law and you and we hereby submit to the exclusive jurisdiction of the English courts.
If you have a profile registered with the WeGotPOP platform and not Extra People, be aware that if you accept any job through our agency on the platform you are also bound by these terms and conditions. Extra People reserve the right to remove artists from our register at any time.
Extra People may update its Terms and Conditions from time to time, so please check it regularly. By accepting offers of work, it is deemed that you have agreed to all of our terms and conditions.
Should any provision of these terms and conditions be declared invalid for any reason, this decision would not affect the validity of any remaining clauses which will remain enforceable. In those circumstances, we are entitled to replace the invalid provision with a similar provision, which would be given to you in writing.
